Terms & Conditions of Service

These Terms & Conditions ("Terms", "Agreement") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("User", "you"), and EDUVERSE: Smart Learning Network ("EduVerse", "we", "us", or "our"), concerning your access to and use of the EduVerse platform, website, and related applications (collectively, the "Services").

PLEASE READ THESE TERMS CAREFULLY. By registering an account, accessing, or using the Services, you acknowledge that you have read, understood, and agree to be bound by all of these Terms. If you do not agree to all of these Terms, you are expressly prohibited from using the Services and must discontinue use immediately.

1. Eligibility and Account Administration

1.1 Age Restrictions: The Services are available to users of all ages; however, users under the age of majority in their jurisdiction must utilize the platform under the supervision of an authorized educator, educational institution, or legal guardian.

1.2 Account Security: You are strictly responsible for maintaining the absolute confidentiality of your account credentials. You agree to immediately notify EduVerse of any unauthorized use of your account or any other breach of security. EduVerse will not be liable for any loss or damage arising from your failure to comply with this security obligation.

1.3 Institutional Authority: If you are establishing an account on behalf of a school, university, or corporate learning center, you represent and warrant that you possess the requisite authority to bind that organization to these Terms.

2. Platform Services & License Grant

2.1 Provision of Services: EduVerse provides a suite of AI-enhanced educational tools, including but not limited to, question paper generation, automated copy evaluation, algorithmic lesson planning, and digital classroom management (attendance, announcements).

2.2 Limited License: Subject to your compliance with these Terms, EduVerse grants you a revocable, non-exclusive, non-transferable, limited license to access and use the Services strictly for personal, academic, or institutional educational purposes.

3. Acceptable Use and Restrictions

As a condition of your license to use the Services, you agree NOT to engage in any of the following prohibited activities:

  • Reverse Engineering: Decompiling, reverse engineering, disassembling, or attempting to derive the source code or foundational architecture of the Services or its embedded AI models.
  • Data Scraping: Using automated systems, bots, spiders, or scrapers to extract data, content, or API endpoints from the Services without explicit written consent.
  • Malicious Conduct: Uploading or transmitting viruses, Trojan horses, malware, or executing denial-of-service (DoS) attacks that interfere with platform integrity.
  • Commercial Exploitation: Reselling, sublicensing, or otherwise commercializing the AI generation outputs as a standalone data product.
  • Academic Misconduct: Utilizing the platform to facilitate cheating, plagiarism, or any violation of the academic honor code of your respective institution.

4. Artificial Intelligence Disclaimers and Limitations

EduVerse integrates advanced Artificial Intelligence (AI) and Large Language Models (LLMs) to generate content and perform evaluations. It is critical that Users understand the inherent limitations of these technologies:

4.1 Algorithmic Inaccuracies (Hallucinations): AI models operate on statistical probabilities and may generate outputs that are factually incorrect, logically flawed, or incomplete. All AI-generated outputs must be reviewed and verified by a qualified human educator or user before being utilized in an official academic capacity.

4.2 Evaluation Variances: AI-based copy checking and evaluation tools are supplementary aids designed to assist—not replace—professional educator judgment. EduVerse assumes no responsibility for grading discrepancies or the resulting academic consequences.

4.3 Output Ownership: Subject to third-party rights and applicable laws, you retain the rights to the specific outputs generated resulting from your unique inputs, provided your use complies strictly with these Terms.

5. Intellectual Property Rights

5.1 EduVerse IP: Excluding User-Generated Content, the Services and all materials therein, including software, proprietary algorithms, UI/UX designs, trademarks, logos, and copyrightable materials ("EduVerse Content"), are the exclusive property of Arindam Srivastava and the EduVerse entity.

5.2 User Content: You retain all ownership rights to the original documents, assignments, and materials you upload ("User Content"). By uploading, you grant EduVerse a limited, secure, non-transferable license to process this content exclusively for the purpose of delivering the requested Services (e.g., evaluating the document).

6. Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. EDUVERSE EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, 100% SECURE, OR THAT DEFECTS WILL BE CORRECTED.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL EDUVERSE, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR LOSS OF ACADEMIC STANDING ARISING FROM YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, OUR LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO US DURING THE SIX (6) MONTH PERIOD PRIOR TO ANY CAUSE OF ACTION ARISING.

8. Indemnification

You agree to defend, indemnify, and hold harmless EduVerse, its affiliates, and their respective officers, agents, partners, and employees, from and against any loss, damage, liability, claim, or demand, including reasonable attorneys' fees and expenses, made by any third party due to or arising out of: (1) your use of the Services; (2) your breach of these Terms; (3) any breach of your representations and warranties set forth in these Terms.

9. Modifications to the Service and Terms

We reserve the right to modify or discontinue all or part of the Services without notice at any time. We also reserve the right to revise these Terms at any time. Updated versions will be indicated by an updated "Effective Date". Your continued use of the platform after changes implies binding acceptance of the revised Terms.

10. Governing Law and Dispute Resolution

These Terms shall be governed by and defined following the laws of India. EduVerse and yourself irrevocably consent that the competent courts of India shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these terms. Any legal action of whatever nature brought by either you or us shall be commenced or prosecuted in the state and federal courts, and the Parties hereby consent to and waive all defenses of lack of personal jurisdiction and forum non conveniens.
